These Terms and Conditions ("Terms") govern your use of the SAEV Charge mobile application (Android and iOS) and web application, and the charging and related services we provide (together, the "Service"), operated by SAEV Charge (Pty) Ltd, registration number 2025/471342/07 ("SAEV Charge", "we", "us" or "our").
By downloading, accessing or using the Service, you agree to these Terms. Please read them carefully. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service you confirm that you meet this requirement.
2. Your account
To use the Service you must register an account using your name, surname and email address, and you may optionally add one or more RFID/NFC tags. You are responsible for keeping your account credentials and any RFID/NFC tags secure and confidential. You are responsible for all activity that occurs under your account or through your tags, including any charging sessions and resulting charges. Please notify us immediately if you believe your account or a tag has been compromised.
3. The Service and the chargers
SAEV Charge enables you to locate charging stations, manage a prepaid wallet of SAEV Coins, and start and pay for electric-vehicle charging sessions.
The Service includes chargers owned and operated by SAEV Charge and may also list chargers owned or operated by third parties. We do not control third-party chargers and are not responsible for their availability, condition, pricing accuracy, or performance. Information about chargers (including third-party chargers) is provided to us in part by third parties, and while we endeavour to keep it accurate and up to date, we do not warrant that it is always complete or correct.
You are responsible for using chargers safely and in accordance with all on-site instructions, signage and applicable laws, and for ensuring that a charger is compatible with your vehicle before use.
4. SAEV Coins
- Nature of SAEV Coins. SAEV Coins are a prepaid value instrument that gives you a right to receive charging services within the SAEV Charge network. Each SAEV Coin has a fixed value of one South African Rand (1 SAEV Coin = ZAR 1.00). SAEV Coins are not money, currency, or a deposit, and do not earn interest.
- Redemption. SAEV Coins are redeemable solely for charging services available through the Service. They remain linked to your account.
- No expiry. SAEV Coins do not expire and remain valid for as long as your account is active, subject to applicable law and the continued availability of the Service.
- Non-transferable. SAEV Coins are not transferable. We do not facilitate account-to-account transfers or redistribution of balances. If you allow a third party to use your account or credentials, that use remains your responsibility and is subject to these Terms.
- Non-refundable. SAEV Coins are non-refundable once purchased and credited to your account, except in the limited circumstances set out in clause 6. A change in your personal circumstances, vehicle ownership, or simply not using your SAEV Coins does not entitle you to a refund.
5. Top-ups and payments
You purchase SAEV Coins by topping up your wallet through our payment gateway, Stitch, which supports Apple Pay, Google Pay, Capitec Pay, Visa and Mastercard card payments, and Stitch Pay Later. Payments are processed by Stitch and the relevant payment providers under their own terms and conditions, and we do not store your full card or banking details.
SAEV Coins are credited to your wallet once payment has been successfully processed and confirmed to us. You are responsible for ensuring that the payment method you use is valid and that you are authorised to use it.
6. Refund policy
- General position. All purchases of SAEV Coins are final and non-refundable once successfully processed and credited to your account, subject only to the limited exceptions below.
- Exceptional circumstances. We may, in our sole discretion, consider a refund request only in limited exceptional circumstances, including:
- duplicate or erroneous payments (subject to verification or audit);
- verified technical, system or billing errors; and
- deceased estate applications (subject to supporting documentation).
- Consumer rights preserved. This policy is applied in accordance with applicable law, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002. Nothing in these Terms limits or excludes any rights you may have under applicable law, and those rights will prevail to the extent of any inconsistency.
7. Charging sessions and tariffs
Charging sessions are charged at the tariffs displayed in the Service for the relevant charger at the time of the session. Tariffs may differ between chargers (including between SAEV Charge chargers and third-party chargers) and may change from time to time. The cost of a session is deducted from your SAEV Coin balance.
8. Offline charging
To help you charge when a charger has limited or no network connectivity, the Service may allow charging sessions to proceed offline.
- Offline sessions are initiated at your discretion and remain subject to the standard tariffs and billing processes.
- Because of how offline sessions are processed, a session may not be billed or appear in your transaction history immediately. The session is billed once the charger reconnects to our network and the session is synchronised and reconciled. This may result in a delay between the session and the deduction from your wallet.
- We do not guarantee the uninterrupted availability of offline charging and may limit, suspend or withdraw this functionality at any time.
- A session successfully recorded and synchronised will be valid and chargeable. We may adjust, correct or reconcile transaction records following synchronisation where discrepancies, errors or irregularities are identified.
9. Negative balance
If the cost of a charging session (including an offline session billed on reconnection) exceeds your available SAEV Coin balance, the shortfall remains an unpaid session and is reflected in your account as a negative balance. The negative balance represents an amount owing by you to SAEV Charge for charging services already received.
- No interest is charged on a negative balance.
- You must settle the negative balance in full (by topping up your wallet) before you will be able to start another charging session.
- We may suspend access to charging until the negative balance is settled and may take reasonable steps to recover amounts owing.
10. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent or abusive purpose;
- copy, modify, distribute, or create derivative works of the app or web app, or any part of them, or our trademarks;
- attempt to extract, reverse-engineer, decompile or derive the source code of the Service, or translate it, except to the extent permitted by law;
- interfere with, disrupt, or attempt to gain unauthorised access to the Service or its underlying systems; or
- damage, tamper with or misuse any charger or related equipment.
11. Intellectual property
The Service, and all trademarks, copyright, database rights and other intellectual property rights in and to it, belong to SAEV Charge (or our licensors). These Terms do not grant you any rights in our intellectual property other than the limited right to use the Service in accordance with these Terms.
12. Third-party services
The Service relies on third-party services, including Stitch (payments) and Google Maps (mapping, location and navigation). These third parties have their own terms and conditions and privacy policies, and your use of those features may also be subject to them. We are not responsible for third-party services that we do not control.
13. Availability, your device, and connectivity
We aim to keep the Service available and accurate but do not guarantee that it will be uninterrupted, error-free, or always up to date.
Some features require an active internet connection (Wi-Fi or mobile data). We are not responsible for the Service not functioning fully where you do not have connectivity or sufficient data. If you use the Service over a mobile network, your network provider's charges (including data and roaming charges) still apply and are your responsibility; if you are not the bill payer, we assume you have the bill payer's permission. You are also responsible for keeping your device sufficiently charged and secure, and we recommend that you do not jailbreak or root your device, as this may compromise its security and may cause the Service to malfunction.
14. Limitation of liability
To the maximum extent permitted by law, SAEV Charge accepts no liability for any loss or damage, whether direct or indirect, arising from your use of, or reliance on, the Service, including from third-party chargers, third-party information, connectivity issues, or the unavailability of the Service. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act 68 of 2008, and your rights under applicable law are not affected.
15. Suspension and termination
We may update, change, or charge for the Service or any of its features at any time, but we will not charge you for the Service or its services without making clear to you what you are paying for. We may also suspend or stop providing the Service, or terminate or suspend your access, including where you breach these Terms or fail to settle a negative balance. On termination, the rights and licences granted to you under these Terms end, and you must stop using and (if required) delete the app. Termination does not affect any amounts you owe us or any SAEV Coin obligations that survive in accordance with applicable law.
You may stop using the Service at any time and may request suspension or deletion of your account by contacting us.
16. Changes to these Terms
We may update these Terms from time to time. We will notify you of changes by posting the updated Terms on this page and updating the effective date above. You should review this page periodically. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
17. Governing law
These Terms are governed by the laws of the Republic of South Africa, and you agree to the jurisdiction of the South African courts, without affecting any mandatory consumer-protection rights available to you.
